We're on a mission to make urgent changes to antiquated laws around surrogacy

We are continuing to grow our 'All Kids Are Equal' campaign to achieve law reform for parents and their children born through surrogacy. The current system isn't supporting those who seek to create a family via surrogacy; it's expensive, messy, frustrating, time consuming and discriminates against parents and their children.

What's the problem?

Thousands of Australian children born through surrogacy do not necessarily have legal parents which leaves some children with less rights than others. We believe all children are equal and deserve to have their families recognised under Australian law. 

Why children need the security of legal parentage

Surrogacy is an incredible, life changing process and having a baby for another family is the biggest gift someone can give to a person or couple yearning to be a parent. In many surrogacy cases, surrogates become part of the village or logical family that helps raise a child, but often don't want to be defined as the parent of the child they carry.

From state to state around Australia there are different laws regarding both domestic and international surrogacy. For all families through surrogacy, parents need to go to court after the baby is born to transfer parentage from the surrogate and her partner to the intended parents. Many families don’t do this for a variety of reasons, leaving their children in legal limbo. We need to simplify this process so that all kids have the people that are raising them recognised as their legal parents.

We seek to amend the current process so that it better supports the intended parents, the surrogate and the rights of the child. This is why we are advocating for surrogacy and parentage law reform.

What we have done so far

Over the past few years we have consulted with families impacted by Australia’s unfair parenting laws. We’ve heard from surrogates, mums and dads and held sessions with families to listen to their experiences and gain a deeper understanding of how these complex laws affect families.

Our working group

Last year we formed a working group of experts, advocates, surrogates, and parents from around the country who are passionate about children's rights who are determined to have families born by surrogacy, legally recognised.

We've been connecting with those who can make the changes we need

We’ve been talking with politicians of all political persuasions to help deliver equality for our families. But we need to do more at a national level to ensure that families from around the country are protected.

What's next?

We are continuing to grow our campaign, raise our collective voice and support our engagement with decision makers in parliament and across Australia.
